? TERMS AND CONDITIONS OF SALE (CGV) — JM GLOBAL
1. GENERAL SCOPE
These Terms and Conditions of Sale apply to all services provided by JM GLOBAL, including professional training, business services, administrative support, as well as immigration and integration services.
The applicable conditions may vary depending on whether the contract is concluded with a consumer (B2C) or a business (B2B).
2. PROFESSIONAL TRAINING SERVICES
Definitions
Inter-company training courses: training sessions delivered from a catalogue, conducted in JM GLOBAL premises or in facilities made available by JM GLOBAL.
Intra-company training courses: training sessions delivered from a catalogue or customised for a specific company.
Any training order implies full and unconditional acceptance of these Terms and Conditions of Sale by the client.
3. CONTRACTUAL DOCUMENTS
JM GLOBAL provides a professional training agreement in accordance with applicable legislation.
Where the training is financed privately, the agreement is replaced by a training contract.
The client agrees to return a signed copy of the contractual document as soon as possible.
For inter-company training, an invoice is issued together with the training agreement.
For intra-company training, an invoice is issued upon confirmation of the order.
A copy of the attendance sheet is provided at the end of the training course.
In case of training purchased via the CPF platform (Personal Training Account), the platform’s Terms of Use constitute the contract between the account holder and the training provider. No additional contractual document is required for CPF-funded actions.
4. PRICING, INVOICING AND PAYMENT TERMS
All prices are stated net, excluding meals and accommodation.
Any training session that has started is fully payable.
For inter-company training courses, JM GLOBAL reserves the right to allocate reserved places freely until full payment of registration fees has been received.
Invoices are payable to JM GLOBAL:
Inter-company training: payable upon receipt of invoice. Meals are not included and remain the responsibility of the client.
Intra-company training: payment terms are defined in the quotation or contract. Advance payment may be required.
Failure to pay an invoice within the agreed timeframe may result in suspension of ongoing or future services after formal notice remains without effect.
JM GLOBAL reserves the right to refuse or suspend services in case of non-payment, without entitlement to compensation.
5. PAYMENT BY SKILLS OPERATORS (OPCO)
If the client requests payment by their Skills Operator (OPCO), it is the client’s responsibility to:
submit the funding request prior to the training;
ensure acceptance of the funding application;
provide accurate billing details.
If the OPCO only partially covers the cost, the remaining balance will be invoiced to the client.
If payment from the OPCO is not received in full by the first day of training, the client may be required to pay the full cost directly.
Any unpaid amounts may incur late payment penalties.
6. CANCELLATION OR POSTPONEMENT
Any cancellation by the client must be communicated in writing at least 10 days before the start of the training.
If this deadline is not respected, JM GLOBAL may retain 50% of the total training fee.
If the training is postponed within one year, in agreement with JM GLOBAL, an additional 50% of the original fee may be charged.
For intra-company training, if participants are absent or late without prior notice (at least 24 hours in advance), the session will be invoiced.
7. BUSINESS SERVICES (B2B)
The provisions relating to professional training mainly apply to individual clients (B2C).
For business-to-business services (including intra-company training, accounting services, administrative support, tax services or consulting services), execution, cancellation, postponement and termination conditions are defined contractually in the quotation, agreement or contract signed between the parties.
No statutory right of withdrawal applies to business-to-business relationships, unless otherwise expressly agreed in writing.
8. DATA PROTECTION AND CONFIDENTIALITY
Personal data collected by JM GLOBAL is used solely for the execution of services and may be shared only with authorised partners such as trainers, subcontractors or public funding bodies (e.g. OPCO).
In accordance with French Labour Code Article L6353-9, any information requested must be directly related to the training or service provided and must be answered in good faith.
Clients may request access, correction, or confidentiality of their personal data at any time.
9. GOVERNING LAW AND JURISDICTION
Any dispute that cannot be resolved amicably shall fall under the exclusive jurisdiction of the Commercial Court of Paris, regardless of the client’s location, except where mandatory legal provisions apply.
JM GLOBAL reserves the right to waive this clause at its discretion.
